Attention: Press and Media: As a known legal and bioethics expert in women’s health I have witnessed the reality that many women’s health issues are lost in getting national coverage. It is clear that language concepts are essential in the education of the public on complex medical issues. At a recent meeting held at the Jungian Institute in Los Angeles a group of female therapists (all well-educated and not isolated persons), I found that only one woman had heard of morcellation. The rest of the group were horrified and found it difficult to believe me as I discussed the event of morcellation. This incident showed me the failure of our nation to learn about man made medical disasters that have cause pain, suffering, dysfunction and yes, even death of women. In order for one to discuss these issues basic terms are needed to begin with. I recalled my years of philosophy and that language is essential in the transference of information. One cannot report on these topics without having a language that the public can understand. Thus I will be providing new terms so that the press and reporters can use the terms and focus on these stories, for the loss of life is ongoing. Sometimes a term is needed to understand an event in our history. When the term “holocaust” came into use, the world was then capable of grasping the horror. There has been little effort to recognize that these stories all need to be told so that action can take place to change “mayhem and killing practices”.

Medical Device Mayhem (MDM): There is no term for medical devices which failed to have proper basic research and have been marketed for profit without proper informed consent and proper review or data bases. This has been seen in the Dalkon Shield, Ovabloc, Essure and other devices that have mutilated the body causing physical harm and psychological and family/life complications. If there is no term it is difficult to educate the public and government to make things understood so that these issues can be discussed properly and action take place. Language is needed to deal with complex medical issues and thus I am giving a name to these events so we have foundation to build on.
MDM stands for "Medical Device Mayhem". MDM means a device was created and for a variety of reasons exists it has caused Mayhem. Mayhem this is an action that renders the patient victim in a disorder of confusion, depression, and havoc. It renders the victim to be impaired so that they cannot function in a previous normal status in which they were functional and could protect themselves. The injury inflected is from the device and or its use application that data provided to have significant permanent crippling, mutilation, dysfunction and or disfigurement of the human body. Ovarian Isolation: Occurs when an ovary is surgically isolated or removed from its blood supply (oopherectomy). The ovary(s) are castrated but not physically removed from the body. The isolated ovary(s) becomes atrophic and nonfunctional. Ovarian isolation occurs most often with hysterectomy, salpingectomy and tubal ligation.
Hormone Shock: Sudden loss or abrupt change of hormones triggering physical shock and manifesting with shock related symptoms.
The symptoms of hormone shock that can manifest after the loss of ovarian function includes: Chills, hot flashes, vaginal dryness, painful intercourse, bladder dysfunction, loss of sex drive, sleep disturbances, headaches, heart palpation's, fuzzy logic, confusion, rage, depression, and memory loss that can mimic an Alzheimer’s type state.
In addition to these symptoms, women who lose both ovaries, or lose the function of their ovaries also lose the protection these hormones provide against heart disease and osteoporosis many years earlier than if they had experienced natural menopause.
Women who have had their ovaries removed or rendered nonfunctional due to ovarian isolation are seven times more likely to develop coronary heart disease and much more likely to develop bone problems at an early age than are pre-menopausal women whose ovaries are intact and functioning.

A pernicious form of gender-based violence
Women urged to file criminal charges
Medical devices (and procedures) in use today which cause MDM (medical device mayhem) include Essure, morcellation, breast implants, ablation, IUDs, Ovabloc, Filshie clips, Uterine Fibroid Artery Embolization (UAE/UFE), and tubal ligation/salpingectomy (for the purpose of female sterilization birth control without full disclosure/consent).
All the medical devices and procedures listed above carry risks of physical, sexual, hormonal mayhem, disfigurement, and death which women and the public are not informed of despite the medical community being fully aware of the risks and having data. Informing of pertinent risks and side effects is paramount in the decision making process of consent. The action of withholding information by women’s health care providers is a type of force used by doctors to persuade women to make the decision the doctors want them to make. The action of withholding information is abuse and a type of fraud which invalidates consent, so in truth, because information was withheld consent was not given.
Medical Assault, the tort of Battery and Mayhem
The key elements of battery are:
Regarding female sexual organs, a physician who fails to obtain consent prior to performing a procedure will be subject to a medical battery/mayhem claim.
Informed consent begins with consideration of the tort of battery. It consists of the non-consensual contact. The contact need not result in bodily harm; the intended contact itself is the harm.
1. Assault occurs with the crimes of omission (what is not disclosed to the patient).
This assault, (withholding information) invalidates consent.
2. With no consent battery occurs the moment the surgery or procedure begins.
3. Mayhem occurs the moment a body part is altered, removed or rendered useless.
With Essure, mayhem occurs with the placement with the device, and (secondary) when hysterectomy,
salpingectomy, post implant syndrome, allergies, autoimmune syndrome and other illness occur.
Vikki Hufnagel, MD, an OBGYN surgeon and whistle-blower explains, “Historically civil law (in the way of medical malpractice suits, etc.) has not caused change nor provided women protection from the batteries and mayhem (battery with malicious intent) which are routinely committed upon them by unethical doctors. In the civil court system, crimes of mayhem are buried and hidden by both the court and the press. After civil suits (which most often are settled out of court) the perpetrators then go on to repeat their actions and crimes of mayhem. The crime of MDM goes beyond negligence and malpractice.
The perpetrators of these crimes exhibit extreme indifference to the physical or psychological well being of their victims. These actions directly relate to the crime of mayhem as doctors know what the risks and outcomes can be yet with intent withhold information (which invalidates consent) and proceed with their actions in order to profit and to obtain unjust enrichment. The harm and trail of devastation these doctors have left with MDM can be compared to the holocaust. There is a movement to shift these cases from the civil courts to the criminal courts in order to produce change and for the protection of all females.”
Activists urge victims of MDM to report these crimes to their local police and authorities (medical boards, states attorneys) as that of a violent crime/battery/mayhem having occurred. Filing a police report can be done in the district in which the victim lives, in the district which the event occurred, or both.
Filing a police report that you or a loved one have been a victim of mayhem and battery (regardless of where the battery occurred) is your right to do so. Be aware that filing a police report that a crime has occurred is not the same as suing a doctor for malpractice. Filing a police report utilizes criminal law while malpractice utilizes civil law. These are 2 different systems. Both systems discipline the perpetrator and orders restitution (payment) but in different ways. Restitution in civil law comes in the way of a payment to the victim for harm (such as pain and suffering) caused by the offender's wrongful acts (generally paid by an insurance company). The doctor who performed the action, while may have been sued, in reality does not suffer any type of punishment. Criminal law actions focus on punishment and restitution (requiring the defendant to make monetary amends, or perform some act that benefits the victim of the crime, or the public in general). Victims who receive restitution through the criminal legal system are not precluded from filing civil suits and proving damages for greater amounts, however a victim cannot receive compensation twice for the same losses.Women have a right to be protected and a right to report to the authorities when a crime has been committed. When mayhem and battery occur many believe the criminal law system is the more appropriate law system to report and file charges.
Filing a Police Report
When filing a police report it is suggested that women write their statement to present to the police and bring a friend for support and witness to the action of reporting the event and crime. If possible bring with you someone from your local news media (a news reporter) to witness the report being made. As a courtesy to your local police, it is suggested that you call in advance to make an appointment when making a complaint of this nature.
Historically, those working in criminal law (police officers) have steered women away from filing criminal reports and towards lawyers and the civil law system when a crime is reported that involves a “doctor”. Do not be surprised if this happens when you go to file your report. Hold fast and stand your ground. Doctors are not precluded from the law. Ask if there is another detective available to speak with or ask to speak with their superior. Everyone you speak with, obtain their name, title, and document the date/time and what was said. As a victim of mayhem and battery it’s your civil right to be able to make a police report detailing the crimes and batteries which you’ve been a victim of. It is not for the police to decide if what occurred in your case was that of a criminal nature or that of a civil nature. They are not lawyers and they are not judges. Their job and role is to take your report and protect members of the community from harm.
